5 minutes before about eight of that guys friends tried to murder Indy with swords. If these guys attacked you would you shoot them or punch them? I personally would have no choice because I'm small and Indy would have been justified to meet lethal force with leathal force. Now when Marion got kidnapped that changed things- Remember the red hot poker she nearly got in the face? Indy knew the same scum had her at that moment, and he didn't have time for a gentlemanly fight with a hired killer..he had to save Marion-NOW.
